When you ask us about a condo, a villa or a new project, you give us your name and your phone number. You should know what happens to them. This page explains it in plain words: what we collect, why, who sees it, how long we keep it, and what you can ask us to do with it.
We follow Thailand’s Personal Data Protection Act B.E. 2562 (2019), called the “PDPA” below.
In short
- We use your details to answer your request and to help you buy, sell or rent property in Pattaya.
- We do not sell your data.
- When you ask about a new project, we may register you with that project’s developer. We share only what is needed for that.
- Our website uses Google Analytics, Google Ads and the Meta pixel to measure visits and show our ads.
- You can ask us at any time to see, correct or delete your data. Write to [email protected].
1. Who is responsible for your data
The data controller is Siam Glow Properties Co., Ltd. (“we”, “us”).
- Address: 505/7 View Talay 7, Thappraya Road, Bang Lamung District, Chon Buri 20150, Thailand
- Email: [email protected]
2. What data we collect
Data you give us
- Contact forms on siamglow.com: your name, email, mobile or WhatsApp number, and your message.
- Facebook and Instagram lead forms: when you fill in one of our forms inside Facebook or Instagram, Meta sends us the answers. Depending on the form, this can include your name, phone or WhatsApp number, email, LINE ID, budget, the type of property you want and when you plan to buy.
- Chat apps: when you write to us on WhatsApp, LINE (@siamglow) or Facebook Messenger, we receive your name or profile name, your number or account ID, and your messages. Some Messenger conversations go through an automated assistant (ManyChat) before a person replies.
- Email and phone calls: what you tell us.
- If you go ahead with a purchase, sale or rental through us: the details needed for the reservation and the contract, for example a copy of your passport or ID, your address, and payment information for a deposit.
- If you are an owner listing your property with us: your contact details and the details of the property, including documents such as the title deed when needed.
Data collected when you visit our website
- Visit statistics: pages viewed, approximate location (country, city), type of device and browser, and the website you came from. Some of this is collected by Google Analytics. Our website also records your IP address when you view a property listing, to count views.
- Advertising data: the Meta pixel and the Google Ads tag tell Meta (Facebook, Instagram) and Google which pages you visited, so we can measure our ads and show them to people who visited our site.
- Technical data: your IP address and browser data pass through our hosting and security providers each time you load a page.
We do not ask for sensitive data, such as health, religion or political opinions. Please do not send it to us.
3. Why we use your data, and on what legal basis
The PDPA only allows us to use your data when we have a legal reason, called a “legal basis”. Here is ours for each use.
- To answer your questions and send you what you asked for (price lists, floor plans, property details, viewings). Legal basis: steps you ask us to take before a possible contract.
- To register you with a developer. When you tell us you are interested in a new project, we may register you as our client with the developer of that project, so you can get their prices and so the developer knows we introduced you. We share your name, your contact details and the project you are interested in, nothing more. Legal basis: steps you ask us to take before a possible contract, and our legitimate interest in being recognised as your agent.
- To manage a sale, purchase or rental and prepare the documents. Legal basis: performance of a contract with you.
- To follow up on your request, for example to check if you are still looking a few weeks later. Legal basis: our legitimate interest in following up on a request you made. You can tell us to stop at any time.
- To send you news about new projects and listings that you did not ask about. Legal basis: your consent. You can withdraw it at any time.
- To measure visits to our website and improve it (Google Analytics, visit statistics). Legal basis: our legitimate interest in understanding how our website is used.
- To measure and target our ads on Facebook, Instagram and Google (Meta pixel, Google Ads tag, remarketing). Legal basis: our legitimate interest in promoting our services. See section 7 to refuse it.
- To meet our legal obligations, for example tax and accounting rules, or a request from an authority. Legal basis: legal obligation.
We do not make decisions about you by automated means only.
4. Who we share your data with
- Our team: our agents, including freelance agents who work with us, when they handle your request. They must keep your data confidential.
- Developers of a new project you are interested in, as explained in section 3.
- The other side of a transaction, when you go ahead: the owner, the buyer or the tenant, and when needed a lawyer, the condominium juristic person or the Land Office, with what each one needs to complete the transaction.
- Service providers who run our tools for us and may only use your data to provide that service:
- web hosting (OVH, server in Singapore) and Cloudflare (website security and email routing);
- Google (Google Analytics, Google Ads, and Google Fonts used to display text on our website);
- Meta (Facebook, Instagram, Messenger, WhatsApp, lead forms and pixel);
- LINE;
- ManyChat (chat assistant) and Make (automation that saves chat requests in our contact list).
- Authorities, when the law requires it.
We do not sell or rent your data to anyone.
5. Data sent outside Thailand
Our website server is in Singapore. Google, Meta, Cloudflare, ManyChat and Make store data on servers in other countries, including the United States and the European Union. This means your data can leave Thailand.
We choose providers who commit in their terms to protect personal data. Some transfers are also needed to answer a request you made or to carry out a contract with you, which the PDPA allows. These providers publish their own privacy rules, for example the Google privacy policy and the Meta privacy policy.
6. How long we keep your data
- Enquiries that do not lead to a transaction: 2 years after our last contact with you, then we delete them.
- Clients who bought, sold or rented through us: 5 years after the end of the transaction, or longer if Thai law requires it, for example for tax and accounting records.
- News about new projects: until you withdraw your consent.
- Listing view statistics with IP address: 12 months.
- Google Analytics: for the period set in our account, at most 14 months.
Messages in WhatsApp, LINE and Messenger also stay in those apps under their own rules.
7. Cookies and similar tools
Cookies are small files stored by your browser. Our website uses:
- Necessary cookies: to remember your language and to protect the site (Cloudflare). The site does not work properly without them.
- Measurement cookies: Google Analytics (cookies named
_ga). - Advertising cookies: the Meta pixel (cookie named
_fbp) and the Google Ads tag.
How to refuse measurement and advertising cookies:
- block or delete cookies in your browser settings;
- install the Google Analytics opt-out add-on;
- change your ad preferences on Facebook and in My Ad Center on Google.
8. Your rights
Under the PDPA, you can ask us to:
- see your data and get a copy, and know where we got it if you did not give it to us yourself;
- receive your data in a common electronic format, or have it sent to another company, when this is technically possible;
- correct data that is wrong or out of date;
- delete your data, or make it anonymous;
- stop using your data for a while (restriction), for example while we check a correction;
- stop using your data (objection), in particular for follow-ups and advertising;
- withdraw your consent at any time. This does not affect what we did before.
Some requests can be refused when the law allows it, for example when we must keep a record for tax reasons. If so, we explain why.
How to make a request: write to [email protected], send a letter to the address in section 1, or come to our office. Tell us your name, what you want, and how we contacted you (form, WhatsApp, LINE…). We may ask for proof of identity before we act, to make sure we give your data to the right person.
We answer without delay and within 30 days. If we need more time, we tell you why and when we will answer. A request is free, except for extra copies or clearly excessive requests.
Complaints: if you think we do not respect your rights, please tell us first. You can also complain to the Office of the Personal Data Protection Committee (PDPC): www.pdpc.or.th.
9. How we protect your data
Only the people who need your data for their work can see it. Our website uses an encrypted connection (HTTPS) and our accounts are protected by passwords. No system is perfectly secure. If a data breach is likely to put your rights at risk, we will inform the PDPC and, when the law requires it, you.
10. Minors
Our services are for adults. We do not knowingly collect data about people under 20, the age of legal majority in Thailand.
11. Changes to this page
We update this page when our tools or the law change. The date at the top shows the last update. If a change affects how we use data you already gave us, we will tell you.
12. Contact
Any question about your data: [email protected], or through our contact page. See also our terms and conditions.
